These general terms and conditions of use (hereinafter CGU) regulate access to and use of the Website under the domain WWW.LINGUALOGIC.ES (hereinafter referred to as the Website), owned by "LINGUALOGIC, S.L.", hereinafter LINGUALOGIC, and with CIF no. B42607101 with registered office at AVENIDA DEL MONTGO, 12 G, 03700 DENIA (ALICANTE), registered in the Mercantile Registry of the province of ALICANTE, Volume 4165, Folio 39, Section 8 Sheet A-162373 I/A 1, telephone no. 966435481 and email lingualogicacademy@gmail.com, other identifying data appear in the Legal Notice, made available to the User who browses or interacts through the Website.

2. PURPOSE.

These General Terms and Conditions of Use (hereinafter, "T&Cs") regulate access, browsing and use of the Website accessible through the WWW.LINGUALOGIC.ES domain, as well as the responsibilities arising from the use of its contents, understood as texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, images, expressions and information.  as well as any other creation protected by national laws and international treaties on intellectual and industrial property.

The main purpose of the Website is to provide corporate information about LINGUALOGIC, as well as to allow direct contact with the company through forms.

Access to the Website by the User is free of charge, without prejudice to the fact that the use of certain services may require prior registration or the contracting of specific services, which will be subject to their own contracting or booking conditions.

The use of the Website confers the status of User and implies full and unreserved acceptance of each and every one of the provisions included in these T&Cs in the version published at the time of access. Therefore, if you do not agree with any of the clauses established herein, you must refrain from using this website.

LINGUALOGIC reserves the right to amend the T&Cs without prior notice and at any time. Likewise, LINGUALOGIC reserves the right to suspend, interrupt or cease operating the Website at any time. Consequently, the User must read the T&Cs carefully each time he/she intends to use the Website.

 "Use of the Website" means any User who accesses and browses the Website, regardless of whether they fill in contact forms, registration, registration as a user, subscription, incidents, comments, among the functions that may be carried out on the Website.

3. CONDITIONS OF ACCESS AND USE OF THE WEBSITE AND CONTENT.

Access to the Website and the Content included therein does not imply any type of guarantee regarding the suitability of the Website and the Content included therein for particular or specific purposes of the User.

LINGUALOGIC may establish limitations and/or additional conditions for the use of and access to the Website and the Content, which must be observed by the User in all cases.

3.1. Access and Use of the Website.

Unless otherwise provided, the use of the Website will be free of charge, without prejudice to the cost of connection through the corresponding telecommunications network contracted by the User.

The User acknowledges that they are over eighteen years of age, and is also aware and voluntarily and expressly accepts that the use of the Website is carried out in all cases under their sole and exclusive responsibility.

In order to register and access certain services or restricted areas of the Website, the User must be over 18 years of age and provide truthful, accurate, complete and up-to-date information.

The  registered User will be responsible at all times for the custody of their password, consequently assuming any damages that may arise from its improper use, as well as from the transfer, disclosure or loss of the same.

The User undertakes to immediately notify LINGUALOGIC of  any event that allows the improper use of identifiers and/or passwords, such as theft, loss or unauthorised access, in order to proceed with their immediate cancellation.

The  registered User may not assign or transfer, under any circumstances, his/her status as a registered user or access credentials to third parties.

Participation in forums, comments, reviews or any other interactive space on the Website must be carried out in compliance with these rules of use, and LINGUALOGIC reserves  the right to remove any content that is offensive, illegal or contrary to these conditions.

The User undertakes to comply with the T&Cs, as well as to comply with the special warnings or instructions contained on the Website and to always act in accordance with the law, good customs and the requirements of good faith, using their utmost attention taking into account the nature and consideration of the service they enjoy. To this end, they will refrain from using the Website in any way that may impede, damage or deteriorate the normal functioning of the same, the goods or rights of LINGUALOGIC, its suppliers, its distributors, the rest of the User or in general of any third party.

Specifically, and without this implying any restriction on the obligation assumed by the User in general in accordance with the previous section, the User undertakes to use the Website:

• Using the Website for purposes that are illicit, illegal or contrary to the provisions of these T&Cs, good faith and public order.
• Not to introduce, store or disseminate on or from the Website any information or material that is defamatory, libelous, obscene, threatening, xenophobic, pornographic, advocating terrorism, inciting violence, discrimination on grounds of race, sex, ideology, religion or that in any way violates the form, public order, fundamental rights,  public freedoms, honour, privacy or the image of third parties and, in general, current regulations.
• Not to introduce, store or disseminate through the Website any computer program, data, virus, code, or any other electronic or physical instrument or device that is likely to cause damage to the Website, to any of the services, or to any of the equipment, systems or networks of LINGUALOGIC, any User, LINGUALOGIC's Suppliers or Distributors or in general of any third party, capable of causing any type of alteration or impeding the normal functioning of the same.
• Impersonating other users, providing false or inaccurate data, or carrying out any action that may mislead about the identity of the user.
• Not to introduce, store or disseminate through the Website any content that infringes the regulations of intellectual or industrial property or the rights of third parties, or in general any content of which they do not have, in accordance with the law, the right to make it available to third parties.
• Reproducing, copying, distributing, making available or in any other way publicly communicating the contents of the Website without the express authorisation of the holder of the corresponding rights.
• Carrying out acts of spamming, unauthorised advertising or mass sending of emails through the forms on the Website.

3.2. Access and Use of Content.

The Contents of the Website are made available to the User with information from both their own sources and from third parties.

LINGUALOGIC strives to ensure that the Contents are of the highest possible quality and reasonably up-to-date, but does not guarantee the usefulness, accuracy, completeness, relevance and/or timeliness of the Contents.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS.

All the contents of the Website, including but not limited to, texts, documents, photographs, drawings, graphics, images, icons, technology, software, databases, sound files, video files, graphic design, source code and other elements that form part of the Website (hereinafter, the "Contents"), as well as trademarks, trade names or other distinctive signs,  are the exclusive property of LINGUALOGIC or of third parties who have authorised their use, all of which are protected by intellectual and industrial property legislation.

Under no circumstances shall it be understood that any licence is granted or that any waiver, transmission, total or partial transfer of said rights is made, nor is any right conferred, and in particular, of alteration, exploitation, reproduction, distribution or public communication of said Contents without the prior express written authorisation of LINGUALOGIC or the corresponding owners.

The User may only access, view and use the Contents for their personal and private use, and their use for commercial or professional purposes is prohibited, as well as their modification, copying, alteration, reproduction, adaptation or translation, in whole or in part, without the express authorisation of the holders of said rights.

Failure to comply with the provisions of this clause may give rise to the exercise of the corresponding legal actions in defence of the rights of LINGUALOGIC and, where appropriate, of the legitimate owners of the intellectual and industrial property rights.

No intellectual or industrial property rights over the Website or any of its component elements are transferred by means of these T&Cs, and the User is expressly prohibited from  reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding or using any of them, by any means or procedure, by any means or procedure.  except in cases where it is legally permitted or authorized by the holder of the corresponding rights.

5. EXCLUSION OF WARRANTIES AND LIABILITY.

5.1. Exclusion of Guarantees and Liability for the Operation of the Website.

LINGUALOGIC does not guarantee the availability and continuity of the operation of the Website or of the services or Content offered therein, nor that the existing content on the Website is up to date. Consequently, it will not be liable in any case for damages of any nature that may arise from:

• The lack of availability or accessibility to the Web.
• Interruptions in the operation of the Website or computer failures, telephone breakdowns, disconnections, delays or blockages caused by deficiencies or overloads in telecommunications lines or on the Internet.
• Damage that may be caused by third parties through illegitimate interference beyond the control of LINGUALOGIC.

LINGUALOGIC will carry out, provided that there are no circumstances that make it impossible or difficult to execute and as soon as it becomes aware of the errors, disconnections and/or lack of updating of the contents, all those tasks aimed at correcting the errors, re-establishing communication and/or updating the aforementioned contents.

Likewise, LINGUALOGIC does not guarantee the technical reliability of its website, or access to its different pages, and is also exonerated from all liability for damages of any nature that may arise from this cause.

In addition, LINGUALOGIC is not responsible for any possible errors or security deficiencies that may occur due to the use by the User of a browser of an outdated or insecure version in the browser or for any damages, errors or inaccuracies that may arise from the malfunction of the browser.

Although LINGUALOGIC adopts the appropriate technical and organisational security measures to protect the Website, it does not guarantee the absence of viruses or other elements that may cause alterations to the User's computer system (software and hardware)  or to the electronic documents and files stored on their system.

Consequently, LINGUALOGIC will not be liable for any damages that may occur due to the presence of viruses or other harmful elements.

In order to reduce the risk of viruses being introduced into the Website, it uses virus detection programs to monitor all Content that it introduces on the Website. However, LINGUALOGIC does not guarantee the absence of viruses or other elements on the Website introduced by third parties unrelated to LINGUALOGIC that may cause alterations in the User's physical or logical systems  or in the electronic documents and files stored in their systems. Consequently, LINGUALOGIC will not be liable under any circumstances for any damages of any kind that may arise from the presence of viruses or other elements that may cause alterations in the User's physical or logical systems, electronic documents or files.

LINGUALOGIC adopts various protection measures to protect the Website, the data collected and the Contents against computer attacks by third parties. However, LINGUALOGIC does not guarantee that unauthorised third parties may have access to the type of use or browsing of the Website by the User or the conditions, characteristics and circumstances in which it is carried out. Consequently, LINGUALOGIC will not be liable under any circumstances for any damages that may arise from such unauthorised access.

LINGUALOGIC will not be liable under any circumstances for the use that users or third parties may make of the Website or the Contents, nor for any damages that may arise from it.

 5.2. Exclusion of Guarantees and Liability for the Contents.

LINGUALOGIC does not guarantee the reliability, usefulness, veracity, accuracy, completeness and timeliness of the Contents. The User acknowledges that the use of the Website and the Contents is carried out under their sole responsibility.

In particular, LINGUALOGIC shall not be liable for any damages that may arise from:

• The lack of legality, quality, reliability, usefulness, veracity, accuracy, completeness and/or timeliness of the Contents.
• The inadequacy for any purpose and the disappointment of the expectations generated by the Contents.
• Decisions or actions taken or avoided by the User based on the information provided on the Website, or damages suffered as a result of actions that are solely based on the information obtained on the Website, including without limitation the loss of profits or business opportunities.

LINGUALOGIC does not edit the Contents of third parties published on the Website and, consequently, does not guarantee nor is it responsible for the legality, reliability, usefulness, veracity, accuracy, completeness and timeliness of said Contents, as well as the Contents owned by LINGUALOGIC.

5.3. Exclusion of liability for services provided by third parties through the Website.

The Website may provide the User with  technical linking devices (such as links, banners, buttons), directories and search tools that allow access to websites belonging to and/or managed by third parties.

LINGUALOGIC does not offer or market, by itself or through third parties, the products and/or services available on these linked sites, nor does it assume any responsibility for the information contained therein, nor for any damages that may arise from access to them.

 5.4. Exclusion of liability for the conduct of Users.

LINGUALOGIC will not be liable for damages of any nature arising from the use that Users make of the Website, as well as the Contents or services offered therein, in contravention of these T&Cs or the law.

6. HYPERLINKS.

Those persons who intend to establish hyperlinks between their website and the Website must observe and comply with the following conditions:

• Prior authorisation will not be required when the Hyperlink only allows access to the home page of the Website, but may not reproduce it in any way. Any other form of Hyperlink will require the express and unequivocal written authorisation of LINGUALOGIC.
• The website on which the Hyperlink is established may only contain what is strictly necessary to identify the destination of the Hyperlink.
• The website on which the Hyperlink is established will not contain information or content that is illegal, contrary to morality and generally accepted good customs and public order, nor will it contain content contrary to any rights of third parties.
• LINGUALOGIC reserves the right to block Hyperlinks directed to the Website that do not have prior express authorisation, even if they comply with the provisions of this point of the General Conditions.

7. ACTIONS IN CASE OF NON-COMPLIANCE.

LINGUALOGIC reserves the right to exercise any actions available by law to demand the responsibilities arising from the breach of any of the provisions of these T&Cs by the User.

8. PARTIAL NULLITY.

The declaration of any of the clauses contained in these T&Cs as null, invalid or ineffective shall not affect the validity or effectiveness of the remaining clauses, which shall remain binding between the parties.

9. PRIVACY AND COOKIES POLICY:

The processing of personal data is regulated in the Privacy Policy and the installation of coolies in the Cookies Policy, both available on the Website.

10. NOTIFICATIONS.

For the purposes of making the appropriate notifications, LINGUALOGIC designates the contact address specified in the Legal Notice.

The email address that the User may provide  during the registration process on the Website, if there is any registration, will be the one used by LINGUALOGIC for the purpose of notifying the User.

The User is obliged to keep the data referred to in this clause duly updated for the purposes of notifications.

All Notifications made  by LINGUALOGIC to the User will be considered validly made if they have been made using the data and through the means indicated above. LINGUALOGIC is not responsible for any damage that may occur due to the violation by the User of their obligation to keep their contact details up to date.

11. GOVERNING LAW AND JURISDICTION.

These T&Cs shall be governed by the provisions of Spanish law.

Any dispute relating to the conditions of use and access to this Website contained in this document of the UGC of the Website, the parties will submit, expressly waiving any other jurisdiction that may correspond to them, unless otherwise determined by law, to the corresponding Courts.
